Terms of Service

Last updated: October 19, 2026 · Effective Date: October 1, 2024

1. Nature of Our Services

GCMSFile.ca operates as an independent private intermediary facilitating Access to Information and Privacy (ATIP) requests submitted under the Access to Information Act (R.S.C., 1985, c. A-1) and the Privacy Act (R.S.C., 1985, c. P-21) of Canada.

Notice of Independence: GCMSFile.ca is not affiliated with, endorsed by, or a branch of the Government of Canada, Immigration, Refugees and Citizenship Canada (IRCC), the Canada Border Services Agency (CBSA), or CSIS. We act strictly as an authorized designated representative upon receiving your signed IMM 5744 consent form.

2. Consent and Authorization (IMM 5744)

By ordering through GCMSFile.ca, you authorize our Canadian representatives to act on your behalf solely for the purpose of requesting your immigration and border records. Under Canadian law, all applicants aged 16 and older included in the request must provide a signed IMM 5744 consent document. You warrant that all information provided is accurate and truthful.

3. Government Processing Timelines & Statutory Extensions

Under Section 7 of Canada’s Access to Information Act, federal institutions must acknowledge and respond to ATIP requests within 30 calendar days. However, under Section 9 of the Act, IRCC or CBSA may issue a lawful statutory time extension if the request requires extensive searches or consultations with foreign visa offices.

GCMSFile.ca guarantees that your application will be submitted to the government within our published intake service standard. We cannot alter or bypass statutory extensions legally applied by federal government departments.

4. Fees and Refund Policy

Our fees cover professional intake review, electronic IMM 5744 form preparation, official government submission fees, liaison services, and secure encrypted delivery.

  • Prior to Government Submission: If you cancel your order before our team files your request with IRCC/CBSA, a full 100% refund will be issued.
  • After Government Submission: Once a formal ATIP request has been filed with the federal government and official tracking has been assigned, service fees are non-refundable.

5. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
